Rules and Regulations Handbook (July, 2004)

I. The Uses: Our community is divided into two areas: (1) Single family units and (2) multiple family units.

General Rules will apply to all residents, however, each area will have specific restrictions in Building Permits.

A. Single Family Areas

Residential sections 1, 2, 3, 4 and 5. Block A, Lots 1-5; Block B, Lots 1-13; Block C, Lots 1-15; Block D, Lots 1-8; Block E, Lots 1-95; Block F, Lots 1-112.

Building Restrictions

• Single Family residential homes only are permitted.
• A duplex or triplex home is not permitted.
• No accessory building allowed for any business.
• Garage shall not be detached.
• Only one commercial vehicle per lot (must have approval of Association).
• No detached buildings without the approval of the Association.
• Building height shall not exceed more than 35 feet (as defined by City of Destin)
• Setbacks: Front - 25 feet; Sides - 15 feet; Rear - 15 feet (except water lots)
• Overhangs not more than four (4) feet from setback line.
• Lot size must be a minimum of 8,000 square feet.
• Building size: Heated and cooling space, 1,200 square feet minimum.
• Easements: See Part E, 4 & 5.

B. Multiple Family Areas

Block C, Lots 15A through 19; Block E, Lot 96; Block F, Lots 113-124; Residential Zone, Lots
1-28; all other “Residential Intensive Apartments” (RIA) per Okaloosa County.

Building Restrictions

• Multiple Family residences may be a duplex, triplex, townhome, apartment or condominium.
• No accessory building may be used for a business.
• Special condominium parking areas need approval of the Association.
• Height maximum of 75 feet.
• Setbacks: Front - as defined by the City of Destin; Sides - 15 feet (exceptions in
PC&Rs, Part C, #5-6); Rear - 15 feet (except water lots)
• Unit Size – minimum 700 square feet.

C. General Rules for Single & Multiple Family Areas

1. Building Permits

a. Any improvement, construction, alteration or demolition requires a permit and approval of the Association before construction may begin.

b. A Permit Form with fees, requirements and pertinent information may be picked up at the Association Office, or by calling the office at 850-837-4753 or from our website, www.holidayisleimprovement.com.

c. The Association shall have the right to disapprove any plans that fail to comply with the Protective Covenants & Restrictions on aesthetic or other reasons.

d. Requirements:

  • No dock beyond six (6) feet of property line.
  • No fences over four (4) feet (see exceptions)
  • No wells without Association approval.
  • No lot may be reduced in area.
  • No lot may be subdivided or combined.
  • All building columns or posts must be enclosed.
  • See application for other requirements.

2. Beaches

a. The beaches and access ways are for the recreational purposes of Holiday Isle residents and their guests.
b. Beach sand and sand dunes shall under no circumstances be disturbed.
c. No vehicles, fires, glass, pets or litter are allowed on the beach.

3. Rentals

a. Short term rentals require a City of Destin permit with an annual renewal. Owners should obtain application form from City of Destin and must send copy to Holiday Isle office.
b. Long term rentals (6 months or longer) need to fill out a permit with the Association office.
c. Signs: Must be displayed and shall be in accordance with City of Destin ordinance:

  • No larger than 18 x 12 inches.
  • No smaller than 16 x 10 inches.
  • Must include name, phone number of rental agent or owner to contact 24 hours a day.

d. All tenants (properties and boat slips) should acknowledge:

  • Parking regulations
  • Noise Ordinance of City of Destin
  • Trash Pickup
  • Trespassing
  • Pet Requirements
  • Beach Rules

e. No rental less than three (3) days allowed.
f. No recreational vehicles or trailers are permitted unless authorized by the
Association.
g. Tenants may not operate a business or create a nuisance.
h. Single family area may ONLY rent as single unit. No duplex or triplex allowed.

4. Maintenance (Sanitation & Health)

a. Owners are responsible to dispose of all debris and trash properly.
b. No waste of any kind shall be dumped in the canals, lakes or pools.
c. Each owner shall obtain trash pickup removal and shall keep all surrounding areas free from trash, debris and any obstructions.
d. All trash cans shall be stored off the street and out of sight when not being picked up.
e. Owners must keep property in good repair, properly painted and clean at all times.
f. Yards and landscaping shall be maintained. Yard debris and trash should be bagged and put out every Thursday for pickup.
g. There shall be no “nuisance” constructed, committed, erected or operated on Holiday Isle.
h. No illegal or obnoxious trade business of any kind shall be permitted.
i. Trash, obstructions, debris and household items must be removed by owner and shall not encroach on adjoining lots or canals.

5. Unslightly Property:

a. Undesirable growths or obnoxious items are not allowed.
b. Unlicensed, improperly licensed or non-operational vehicles, boats, trailers or recreational vehicles are prohibited.
c. Boats, trailers and recreational vehicles may not be “stored” without approval of the Association and must be parked off the right-of-way, to the rear of the lot.

6. Soil Stabilization

a. All lot owners must immediately take the necessary steps to stabilize sand, soil, rocks, etc. and keep them from leaching into canals or adjoining property (seawalls recommended).
b. Each stabilization plan must have approval of the Association.
c. Sand may not be removed from one property to another or sold without the permission of its owner.
d. No excavation (except for construction of improvements).
e. No topsoil, except landscaping or gardening, shall be used and must be kept from leaching on adjacent property or waters.

7. Parking

a. Minimum of two (2) parking spaces per lot.
b. Owners must provide off street parking for construction and provide supervision in the event of deliveries that block a street.
c. No parking on right-of-ways, sidewalks or on streets is allowed.
d. Boat dock lots must provide off street parking.
e. Boat slip rentals or use on lots without homes must have approval of the Association and require a permit from our office. No more than two (2) rentals per lot is allowed. Boat slip tenants must observe rental rules (see Page 7, 3d.)
f. No one may live on a boat docked in the canals.
g. Boat trailers and all recreational vehicles may not be parked in the right-of-ways or stored on holidays (unless in a garage or out of sight).
h. No commercial vehicles, boats, trailers or recreational vehicles allowed on holidays without a permit and approval of the Association.
i. No temporary construction structures, or trailers, or machinery are allowed on Holiday Isle without approval of the Association.

8. Signs

a. “For Sale” or “For Rent” signs shall not exceed two (2) feet square.
b. Street names, sales promotions and construction signs shall be approved by the Association.

9. Businesses

a. No businesses allowed except Home Occupation with full compliance of the following:

  • Owner must file Home Occupancy Permit with Holiday Isle Office.
  • No one but immediate members of owner’s family can engage in an occupation.
  • No more than 25% of the home can be used for the occupation.
  • No change in appearance of home other than one (1) sign, not exceeding
    two (2) feet square, non-illuminated on the wall of the home.
  • No occupation in an accessory building.
  • No more traffic than usual generated from the occupation.
  • No parking for occupation allowed in street or on right-of-way.

10. Pets

a. No pets allowed on beach.
b. Pets must be leased in public areas.
c. All owners are responsible for their pet’s behavior and waste pickup.

II. Late Fees on Annual Assessments

Holiday Isle Improvement Association, Inc. operates on a fiscal year of Nov. 1st through Oct. 31st. Single family residences are assessed annually $200.00 per property and multiple family units are assessed $150.00 per property. Invoices are mailed out annually in November. After Jan. 15th, assessments not received by the office are considered late. It is the owner’s responsibility to notify the office if they did not receive an invoice or correct their mailing address. Late fees of $25.00 per property owned will accrue monthly until assessment is paid. If payment is not received, legal action will be taken.

III. Addresses, Telephone & Email Corrections

Property owners are responsible to update the office on any address, telephone or email corrections. This may be done by mail, fax, telephone or at our website at www.holidayisleimprovement.com.

IV. Sale of Properties

Holiday Isle Improvement Association, Inc. must be notified of sale of properties. Title companies must fax our office at 837-4984 before closing to see if any assessments are due. There is a transfer fee of $50.00 per sale.
